Weston Motorcycle Accident Attorney

Weston riders head out on Alligator Alley, cruise U.S. 27 along the Everglades or simply commute on I-75 and Weston Road. When a driver turns in front of a motorcycle or drifts into its lane, the rider pays the price. Tomas Robirosa helps injured riders and their families, in English or Spanish.

Motorcycle claims in Florida follow some special rules: riders usually don't have PIP for their own injuries, helmet questions come up, and insurers are quick to blame the person on the bike. If you are looking for a Weston motorcycle accident attorney or lawyer, this page explains how these claims generally work. It is general information, not legal advice; every case is different.

Where Motorcycle Crashes Happen in Weston

Weston is a planned city of about 69,600 people (U.S. Census Bureau, July 2025 estimate) on the edge of the Everglades. Its wide boulevards, roundabouts and highway connections make it a popular place to ride, but each road has its own risks:

  • I-75 and Alligator Alley High speeds, trucks and long-distance drivers who may be tired or distracted. Wind gusts and sudden rain on the open stretches across the Everglades can make riding harder.
  • The I-75 and I-595 interchange Drivers merging between the two interstates change lanes quickly and may not check the blind spot where a motorcycle is riding.
  • State Road 84 intersections Signalized intersections beneath I-75, such as Bonaventure Boulevard, bring left turns, ramp traffic and red-light runners together.
  • Roundabouts and boulevards Drivers who misjudge a motorcycle's speed when entering a roundabout or turning from a side street into a boulevard can cut directly into the rider's path.
  • U.S. 27 and the western edge Fast traffic and open stretches near the Everglades can make crashes on the western fringe especially serious.

Florida Motorcycle Laws That Affect Your Claim

  • No PIP for the rider Florida's PIP law covers vehicles with four or more wheels, so a motorcyclist generally doesn't have PIP for their own injuries the way a car driver does. That makes the at-fault driver's coverage and your own uninsured/underinsured motorist coverage especially important.
  • Helmets Under section 316.211 of the Florida Statutes, riders over 21 may ride without a helmet if they carry an insurance policy with at least $10,000 in medical benefits, and eye protection is required. Not wearing a helmet doesn't, by itself, bar a claim, but the insurer may argue that it made certain injuries worse.
  • Lane splitting Riding between lanes of traffic isn't allowed in Florida (section 316.209). If it was involved, expect the other side to raise it.
  • Comparative fault In general, a rider found more than 50% at fault cannot recover damages, and a rider found 50% or less at fault has the recovery reduced by that share.

Overcoming the "Reckless Rider" Assumption

Adjusters, other drivers and even jurors sometimes assume that the person on the motorcycle must have been speeding or showing off. In reality, many motorcycle crashes happen because a driver simply didn't look. Overcoming that assumption takes evidence: photos of the scene, where each vehicle was damaged, skid marks and debris, witness statements, business or traffic camera video, and sometimes an accident reconstruction.

Protect your claim from the start. Don't guess about your speed when you talk to an adjuster, don't post about the crash or your recovery on social media, and keep your helmet, jacket and other gear exactly as they were after the crash.

Steps to Take After a Motorcycle Crash in Weston

  1. Get medical help. Call 911 and get checked even if you think you're fine; adrenaline can hide serious injuries.
  2. Get the crash report. On Weston city streets, Broward Sheriff's Office deputies from the Weston District usually respond. Crashes on I-75 and I-595 are often handled by the Florida Highway Patrol.
  3. Preserve the bike and your gear. Don't throw away your helmet or damaged parts, and don't rush to repair or sell the motorcycle before it can be inspected.
  4. Take photos. Photograph the motorcycle, the other vehicle, the road surface, any debris, skid marks and your injuries.
  5. Talk to a lawyer before giving a statement. Adjusters may try to get you to agree that you were speeding or weaving.

Injuries, Insurance and What a Claim Can Include

A rider has almost nothing between the body and the road, so motorcycle injuries are often serious: broken bones, road rash, head and spinal injuries, and injuries that need surgery or months of therapy. A claim against the at-fault driver may include past and future medical care, lost income, lost earning ability, damage to the motorcycle and gear, and pain and suffering.

Because riders usually have no PIP, the coverage question comes up right away. If the at-fault driver carries little or no bodily injury coverage, uninsured/underinsured motorist coverage on your motorcycle policy may help, if you have it. Health insurance may pay some bills and later ask to be repaid from a recovery. We review every policy so nothing is overlooked.

Time limits

For most negligence claims in Florida, the deadline to file a lawsuit is generally two years from the date of the crash. Every case is different, so speak with an attorney to confirm the deadline that applies to you.

Frequently Asked Questions

Does PIP pay for my injuries after a motorcycle accident in Florida?
Generally, no. Florida's PIP law covers vehicles with four or more wheels, so riders usually don't have PIP for their own injuries. The at-fault driver's insurance and your own uninsured/underinsured motorist coverage become very important.
Can I still make a claim if I wasn't wearing a helmet?
Generally, yes. In Florida, riders over 21 with at least $10,000 in medical benefits coverage may ride without a helmet. The insurer may argue that a helmet would have reduced some injuries, which can affect the value of the claim.
The driver says they never saw my motorcycle. Does that matter?
"I didn't see the motorcycle" is not a defense. Drivers must watch for motorcycles like any other vehicle. Photos, witness statements and video can help show what really happened.
I was hit by a driver entering a roundabout in Weston. Who is responsible?
In general, drivers entering a roundabout must yield to traffic already in it. If a driver pulled in front of you, that driver may be responsible, but the facts matter, so photos, witnesses and any video are important.
How long do I have to file a motorcycle accident claim?
For most negligence claims in Florida, the deadline to file a lawsuit is generally two years from the date of the crash. Every case is different, so speak with an attorney to confirm the deadline that applies to you.
Can I talk to the lawyer in Spanish?
Yes. Tomas Robirosa speaks Spanish and English.

As a physical therapist, I’ve had the opportunity to work with Robirosa Accident & Injury Law while treating patients recovering from injuries. Their team has always been professional, responsive, and genuinely focused on making sure their clients receive the care they need. From a healthcare provider’s perspective, communication and coordination can make a huge difference in these cases, and their team does a great job staying involved without interfering with the clinical process. It’s clear they care about their clients as people, not just as cases. I would highly recommend Robirosa Accident & Injury Law to anyone looking for an injury attorney who is professional, accessible, and committed to helping their clients through the recovery process.
