Many drivers ask: is Florida a no-fault state, and what does that mean when you are actually hurt in a crash? The short answer is yes. Your own insurance pays first, up to a limit, and you can go after the at-fault driver only in certain situations. Bills to replace the no-fault system have been proposed in the Florida Legislature, but none has become law, and as of 2026 Florida drivers are still required to carry Personal Injury Protection (PIP). Is Florida a No-Fault State? What “No-Fault” Means

In a no-fault system, each driver’s own insurance pays for certain injury-related losses after a crash, no matter who caused it. In Florida, that coverage is called Personal Injury Protection, or PIP, and the rules are in section 627.736, Florida Statutes. So when people ask “is Florida a no-fault state,” this is the system they mean.

  • Required coverageFlorida drivers must carry at least $10,000 in PIP and $10,000 in property damage liability.

The $10,000 Limit and the Emergency Medical Condition Rule

PIP medical benefits are limited. If a qualified medical provider determines that you had an emergency medical condition, PIP medical benefits can be available up to the full $10,000 limit. If not, medical benefits may be limited to $2,500. For a serious injury, $10,000 is used up quickly, which is why other coverage matters.

When You Can Sue the At-Fault Driver

No-fault does not mean no one is responsible. You can step outside the no-fault system and make a claim against the at-fault driver for pain and suffering when your injuries meet Florida’s injury threshold, which generally requires (see section 627.737, Florida Statutes):

  • Significant and permanent loss of an important bodily function;
  • A permanent injury within a reasonable degree of medical probability;
  • Significant and permanent scarring or disfigurement; or
  • Death.

You can also generally recover economic losses beyond what PIP pays, such as medical bills over your PIP limit.

Is Florida a No-Fault State for Every Crash? Fault Still Matters

Even in a no-fault state, fault decides who pays for vehicle damage and who is responsible for injuries beyond PIP. Florida uses modified comparative negligence: if you are more than 50% at fault, you cannot recover damages from the other driver; at 50% or less, your recovery is reduced by your share of fault.

Coverage worth checking on your own policy
  • Uninsured/underinsured motorist (UM) coverage: Florida does not require most drivers to carry bodily injury liability insurance, so UM coverage can be critical if the other driver has little or none.
  • Medical payments coverage: optional coverage that can help with costs PIP does not pay.
  • Collision coverage: pays for your own vehicle damage regardless of fault, subject to your deductible.

What About Motorcycles, Pedestrians, and Rideshare?
