Most motorcycle crashes are caused by drivers who say they "never saw" the rider. Riders still end up with the worst injuries and the most suspicion from insurance companies, who often assume the rider was speeding or weaving.

Where Riders Get Hurt in Boca Raton

Crashes involving motorcycles happen across the city, but certain roads come up again and again:

  • Glades Road and Palmetto Park Road, where drivers turn left across traffic into shopping centers and neighborhoods

The most common crashes we see are left turns in front of a rider, lane changes into a rider's blind spot, rear-end crashes at lights, and drivers pulling out of driveways and side streets.

Florida Rules That Change a Motorcycle Claim

No PIP for riders. Florida's no-fault PIP law applies to vehicles with four or more wheels, and Florida does not require insurance to register a motorcycle. A rider generally has no PIP on the bike, so medical bills usually come from the at-fault driver's bodily injury coverage, your own uninsured/underinsured motorist coverage, medical payments coverage or health insurance.

Helmets. Riders over 21 may ride without a helmet only if they carry at least $10,000 in medical benefits coverage for motorcycle-crash injuries, and every rider must wear eye protection. Not wearing a helmet does not cause a crash, but insurers may argue it made a head injury worse.

Lane splitting. Riding between lanes or between rows of vehicles is illegal in Florida, and insurers raise it whenever they can. Video and witnesses often settle that question.

Shared fault. Since March 24, 2023, your compensation is reduced by your share of fault, and a person more than 50% at fault generally recovers nothing.

Injuries and What You Can Recover

Motorcycle crashes often cause fractures, road rash, head and brain injuries, spinal injuries and injuries that need surgery and long rehabilitation. Depending on the case, compensation may include past and future medical care, lost income and earning ability, pain and suffering, scarring, and the cost to repair or replace your motorcycle, helmet and gear. When a crash is fatal, the family may have a wrongful death claim.

What to Do After a Motorcycle Crash in Boca Raton

  1. Call 911 so there is a police report, and get checked even if you think you are fine.
  2. Photograph the scene, the vehicles, your bike, your helmet and gear, and your injuries.
  3. Get the driver's insurance information and the names of witnesses.
  4. Look for cameras: shopping plazas, traffic cameras, doorbells and dashcams. Video is often erased within days.
  5. Keep your damaged helmet and gear exactly as they are.
  6. Do not give a recorded statement to the other driver's insurer, and talk to a lawyer before accepting any offer.

Deadlines and Where a Case Is Filed

For most crashes after March 24, 2023, Florida generally allows 2 years to file a negligence lawsuit, with extra notice rules if a government vehicle or a dangerous public road was involved. Every case is different, so speak with an attorney to confirm the deadline that applies to you.

Most claims settle. If a lawsuit is filed in Palm Beach County state court, it is handled by the Fifteenth Judicial Circuit, which has its main courthouse in West Palm Beach and a South County Courthouse in Delray Beach.
