• I-95 carries trucks between Miami-Dade, Broward and the rest of the East Coast, with four interchanges in the city. Merging and weaving near the Glades Road, Palmetto Park Road and Yamato Road exits is a common setting for truck crashes.
• Florida's Turnpike runs along the western edge of the city, with an interchange at Glades Road.

Who Can Be Responsible for a Truck Crash

A car crash usually involves one driver and one insurer. A truck crash can involve several companies, each with its own coverage:

• The driver, for speeding, distraction, fatigue or impairment
• The motor carrier, for how it hired, trained, scheduled and supervised the driver and maintained the truck
• The shipper or loader, if cargo was overloaded or poorly secured
• A freight broker, in some cases, depending on its role
• Repair shops and parts makers, for defective brakes, tires or parts

Federal rules require for-hire interstate carriers to carry at least $750,000 in liability coverage for general freight, and $1,000,000 or $5,000,000 for certain hazardous loads. Local delivery vans may carry very different coverage, so we identify every company and every policy early.

Federal Safety Rules and the Evidence That Proves Them

Most commercial truck drivers must follow Federal Motor Carrier Safety Administration (FMCSA) rules. A property-carrying driver generally may drive no more than 11 hours after 10 consecutive hours off duty, may not drive past the 14th hour after coming on duty, and must take a 30-minute break after 8 hours of driving. Since December 2017, most trucks have had to record those hours on an electronic logging device (ELD).

Other key evidence includes the engine control module ("black box") data on speed and braking, dashcam video, dispatch messages, inspection and maintenance files, and the driver's qualification and drug-testing records. Some of it can be overwritten quickly, so we send written preservation demands right away.

Florida Rules That Affect Your Truck Claim

PIP pays first. If you were in a car, your own PIP coverage generally pays 80% of reasonable medical bills and 60% of lost income, up to $10,000, regardless of fault. Serious truck crash injuries usually cost far more, which is why the trucking company's coverage matters.

Shared fault. Since March 24, 2023, Florida reduces your compensation by your share of fault, and a person more than 50% at fault generally recovers nothing. Trucking insurers often try to shift blame for exactly this reason.

Deadlines. For most crashes after March 24, 2023, Florida generally allows 2 years to file a negligence lawsuit, and claims against government agencies have extra notice rules. Every case is different, so speak with an attorney to confirm the deadline that applies to you.
